Your rights

If your personal data are being processed by the Ministry, you have a number of rights.

If you wish to exercise your rights, you should contact the Ministry which will also be able to provide you with further information about your rights.

Duty of disclosure

In many situations, the Ministry is required to notify you when collecting personal data from you. For certain types of cases, this information can be found on this website.

Right to rectification (correction)

The Ministry is required to process data that are correct and up-to-date. If it turns out that the Ministry is processing data about you which are not correct, you are entitled to have the data corrected. In such event, you should contact the Ministry and ask for rectification. The Ministry only has access to rectifying information in its own case documents and registers.

Right to erasure

In special situations, you are entitled to request that information about you is erased prior to the time when the Ministry would generally otherwise perform such erasure. However, it should be noted that, as a public authority, the Ministry is subject to rules which mean that there are many situations where we are not permitted to erase the data being processed.

Right to restriction of processing

In certain situations, you are entitled to request that the processing of your personal data is restricted. If you are entitled to have the processing restricted, this means that, in future, the Ministry must only process the data – with the exception of storage – with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another person or for reasons of important public interest. 

Right to object

In certain situations, you are entitled to object against the Ministry's processing of your data even though it is legal.

Right to have data transmitted (data portability)

In certain situations, you are entitled to receive your personal data in a structured, commonly used and machine-readable format and to have those data transmitted from one data controller to another without hindrance. However, it should be noted that, in most situations, this right will not apply to processing by public authorities, including by the Ministry.
